In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 28th September 2007, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to the submitted documents and drawings HLK/07/088/1, HLK/07/088/2, HLK/07/088/3, HLK/07/088/4 and HLK/07/088/5 all received on 8th August 2007.

3. In the interests of road safety a visibility splay of 2 metres by 36 metres in each direction must be provided to facilitate safe access and egress of the traffic associated with the

units, and on-site parking shall be provided within the curtilage of the units to comply with the provisions of Manx Roads 1.

4. The roof(s) must be finished in dark natural slate.

NOTE This scheme would appear to fall within the scope of the Fire Precautions (Flats) Regulations 1996, therefore the applicant is to consult with the Fire Safety Department to ensure compliance with the regulations.

NOTE The proposed apartments must, on completion of the proposed works, comply with the requirements of the Housing (Flats) Regulations 1982 and be registered thereafter under the same Regulations.

NOTE For connections to Flats and Apartments the following apply - "Water Supply To Flats And Apartments - Regulations", and if applicable a "Form Of Undertaking In Respect Of Supply Pipes" will be required. Copies of these documents can be obtained from the IoMWA or alternatively by contacting the IoMWA Byelaws Inspector (Michael Karran), tel. 69 59 57

NOTE The applicant is advised to consult the Disability Access Office with regard to the needs of disabled users within the building.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

### Guidance Note

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, is available for inspection at the Department.
