In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 9th October 2007, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to the submitted documents and drawing 1324-01 all received on 15th August 2007.

3. Prior to the commencement of any works, there must be submitted to and approved by the Planning Authority, a scheme which shows adequate planting along the eastern boundary with 35 Ashberry Avenue to provide adequate screening.

4. All planting in landscaping scheme, agreed in accordance with the requirements of the condition no. 3 of this approval, must be carried out in the first planting season following the cessation of the development that as is required by condition no. 1 of this approval. Any trees or plants that within a period of five years from the completion of the development die, are

removed, or become seriously damaged or become diseased must be replaced in the next planting season with others of a similar size and species.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either;

- Any appeal has been determined;

Whichever is the later.
