The property is a three storey terraced house with what appear to be timber framed casement windows in place. #### Planning Status And Relevant Policies The property lies within an area of Mixed Use on the Peel Local Plan which was approved by Tynwald in 1990. The property also lies within Peel's Conservation Area where the policies of Planning Circular 1/98 apply. Within such areas the Circular suggests that where original windows are in place the Department's preference is for refurbishment rather than replacement. In cases where the originals are not in place then the replacements should replicate the patter and form of the originals where these are readily visible to the public. #### Planning History There have been no planning applications submitted in respect of this property. however there have been other applications for the replacement of windows in property within the two terraces of Mona Street which are relevant to this application: PA 01/2679 - replacement of windows - split decision (front elevation second floor (casements) refused, rear casements approved and front ground and first floor sliding sashes approved) - 23, Mona Street
PA 02/0827 - installation of sliding sashes on the second floor - permitted - 23, Mona Street [Table omitted in markdown export] PA 02/1265 - installation of sliding sashes on front casements on rear - permitted - 21, Mona Street PA 05/1425 - installation of sliding sash windows - permitted - 9, Mona Street (plastic framed) and PA 06/0094 - installation of casement windows - 6, Mona Street - permitted (these looked identical to sliding sashes when closed). PA 07/00706 - Installation of replacement front windows and door – 7, Mona Street – Permitted. ### The Proposal Proposed here is the replacement of the existing windows with plastic framed casement opening windows. ### Assessment Section 18 (4) of the Town and Country Planning Act 1999 states "Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act. Environment Policy 35 of the Isle of Man Strategic Plan 2007 states that "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development". Planning Circular 1/98 makes reference to the opening style of replacement windows within Conservation Areas and does not insist that the material for the frames is identical. This is reflected in the approvals which have already been granted in Mona Street (see above). Whilst the colour of the frames will change (the windows are presently painted blue). The replacement windows will not match with the general character of the locality i.e. sliding sash windows. If this application were to be approved it would be a missed opportunity to install sliding sash windows which will enhance the character and appearance of the building within the Conservation Area. I consider the installation of casement windows will not preserve or enhance the character and appearance of the Conservation Area and would be detrimental to the visual amenities of the street scene. ### Recommendation I therefore recommend that the application be refused for the above reason. ### Party Status The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status. ### Recommendation Recommended Decision: Refused Date of Recommendation: ### Conditions and Notes for Approval / Reasons and Notes for Refusal C : Conditions for approval N : Notes attached to conditions R : Reasons for refusal - : Notes attached to refusals R 1. The installation of the replacement casement windows would be contrary to Environment Policy 35 and Planning Circular 1/98 in that the replacement windows would be out of keeping with the general character of the street and would not preserve or enhance the character and appearance of the Conservation Area, to the detriment of the visual amenities of the locality.
