### Officer's Report

#### The Site

The site defined in red represents the curtilage of a development situated on the south western side of Farrant's Way and to the north west of Scarlett Road. The site is presently being developed for an apartment block with public and private car parking (see below). Also defined in blue is another site to the south east which is in the ownership of the applicant but is not associated with this development.

#### Planning Status

The site lies within an area designated on the Castletown Local Plan of 1991 as Residential and on the draft Castletown Area Plan of 2001 as Proposed Residential.

#### Planning History

A series of applications have been submitted for the development of this site for apartments and a car park. The one which is being implemented is PA 03/0520 which was amended under PAs 06/1655 and 07/0779.

## The Proposal

Now proposed is a change in material in respect of the car park surface. In the original planning application, PA 03/0520 show block pavilions on the circulation space within the car parking area and contrasting grey surfacing on the parking spaces themselves. Now proposed is a change to the public spaces - finishing these in tarmacadam. The applicant explains that this contrast will help users of the car park differentiate between the public and private areas. He also explains that the tarmacadam will help reduce on-going maintenance costs if and when the public spaces are adopted.

## Representations

There is a letter which has been sent to the Minister which refers to the application but expresses concern that the works have already been commenced. He states that he has no objection to the change in material itself.

## Assessment

The change in material will have no adverse impact and whilst I do not accept that the use of tarmacadam will reduce on-going maintenance costs (and even if it did, this would not be a planning consideration), it will help to distinguish to the users of the public car park, which areas are available to them rather than straying into the private parking areas.

## Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The occupant of 3, Scarlett Close is very close to one of the parking areas which is proposed to have a change of material and as such should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the finishing of the public car parking spaces in tarmacadam as shown in plans reference 2137/20 and -21A both received on 22nd August, 2007.
