Site

The application site is the residential curtilage of Hawthorn Cottage, Maughold, which is a two storey detached property which is located within the centre of Maughold Village.

Land Use Zoning

The site has been zoned under the Isle of Man Development Plan Order 1982 as being within an area of 'white land' not zoned for development; the site is not within a Conservation Area, but is zoned within an area of High Landscape Value or Costal Value and Scenic Significance.

Proposal

The application proposes the erection of a summer house.

Representations

Maughold Commissioners:-
The Commission notes that at its present height the hedge will obscure the view of this summerhouse from those visiting the Green and Churchyard in Maughold Village.

Concern was expressed however that a negative impact may result on the appearance and character of the Village Green and surrounding area if in future the hedge is reduced to a size that would reveal the summerhouse.

The Commission is content to leave assessment of this matter to the discretion of the Planning Officer and Planning Committee.

Highways Division:-
Do not oppose

The Drainage Division makes no comment on the merit of the proposed development but request that an informative note be attached to any approval decision notice.

We have received no privately written representations objecting to the application. Assessment / recommendation The proposed summer house would have a length of 3.6 metres, a width of 2.7 metres and a maximum height of 2.1 metres.

Along the northern boundary of the application site consists a mature hedgerow with an approximate height of between 2 and 2.3 metres. The Commissioners have commented that the summer house might impact upon the visual appearance of the area if the hedgerow was reduced in size. Whilst this is also a concern the Conservation Officer and I have, on balance, I consider that the proposal if constructed now would not be visible for a public highway, and therefore to refuse the application on the grounds of possible changes to the hedge in the future would be inappropriate.

For these reasons the proposal would seem appropriate in this location and therefore my recommendation is for an approval.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the submitted documents and drawings 1616/1, 1616/2, 1616/3 and 1616/4 all received on 29th August 2007.

C 3. There must be No discharge of surface water (directly or indirectly) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.

Public sewerage crosses this site. The line of the sewer(s) must be identified before development work commences. The sewer(s) must be fully protected whilst all building works are being carried out.

C 4. Prior to the commencement of any works, there must be submitted to and approved by the Planning Authority, a sample of the external finish of the roof.
