### Officer’s Report

#### The Site

The application site forms part of the golf course (18th Green) at Mount Murray Country Club, Braddan. The site takes access from Fairways Drive and is situated to the east of the Country Club and the main access into the area development for residential purposes.

#### Planning Status

The application site is located within an area zoned as Tourism Accommodation in Parkland within the adopted Braddan Local Plan, Planning Circular 6/91. This designation covers the area which is now developed with housing.

It is considered that the following policies contained with the Isle of Man Strategic Plan are relevant in the consideration of this application:

### Planning History

Whilst there has been a significant planning history relating to the Mount Murray development, it is considered that there have been no previous planning applications that are relevant in the consideration of this specific site.

### The Proposal

The application proposes in principle, the construction of a single dwelling on land at Fairways Drive, Mount Murray, Braddan

### Representations

Braddan Parish Commissioners object to the application on the grounds that the application is on a contrived plot that is not zoned for residential development. In addition, the Commissioners advised that the proposal is on land used as an amenity area and approval would set a precedent.

The Department of Transport Drainage Division object to the application on the grounds the grounds that the receiving Sewage Treatment Plant at Mount Murray is currently hydraulically overloaded and the Department of Transport Drainage Division will not permit any additional foul flows to be connected the existing system until such time as the works have been replaced as part of the IRIS Scheme.

The Department of Transport Highways Division did not submit comments in relation to the application and

The Isle of Man Water Authority requested a standard Note be attached should planning permission be granted.

A large number of local residents object to the application, which includes a petition signed by 54 residents. The objections can be summarised as: additional traffic and resultant danger to pedestrians; the proposal would set an undesirable precedent; the land is not zoned for residential development and loss of open space and outlook.

Mr Martyn Quayle MHK wishes to register his objects to the application.

### Assessment

The application proposes the development of a single plot on an area identified as being part of the Mount Murray Golf Course, a use that is in accordance with the zoning of the land within the adopted local Plan for the area (Planning Circular 6/91). As such the proposal would be contrary to the land use designation contained within the Local Plan. In addition, it is considered that, without evidence to the contrary, the proposal would adversely impact on the vitality and viability of the golf course use and the associated hotel, a use that is in accordance with the land use zoning.

Furthermore, the development of this plot would set an undesirable precedent for further residential development in this area, contrary to the adopted land use zoning.

The Department of Transport Drainage Division advise that the receiving Sewage Treatment Plant at Mount Murray is currently hydraulically overloaded and the Division will not permit any additional foul flows to be connected the existing system until such time as the works have been replaced as part of the IRIS Scheme. The Department of Transport commissioned an Independent review of the IRIS scheme in 2006, the findings of which are to be presented to Tynwald Members during the October

sitting, and therefore no timetable is currently in place to replace the existing sewage treatment plant.

Comments in relation to the highway network and lack of pedestrian pathways are noted, however, it is not considered that the construction of an additional dwelling would impact significantly on the existing highways network.

### Recommendation

It is recommended that the application be refused.

### Party Status

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:

Braddan Parish Commissioners

Department of Transport Drainage Division and Highways and Traffic Division.

Whilst a large number of local residents object to the application, it is considered that the following accord with provisions of Planning Circular 1/06 and are therefore accorded interested party status:

Mr C M A Clark – 101 Fairways Drive, Mount Murray

Mr M Chapman – 102 Fairways Drive, Mount Murray.

The Isle of Man Water Authority should not be afforded party status as they raise standard points relating to providing water supplies to the site.
