In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 12th October 2007, for the reasons set out below.

### Reasons For Refusal:

1. The proposal would be contrary to the land use designation contained within the adopted Local Plan (Braddan Parish District Local Plan Planning Circular 6/91) and furthermore, without evidence to the contrary, it is considered that the proposal would adversely impact on the vitality and viability of the golf course use and the associated hotel, a use that accords with the current zoning of the site.

2. The development proposed would set an undesirable precedent for further residential development in this area, contrary to the adopted land use zoning.

3. There is currently insufficient capacity within the Sewage Treatment Plant at Mount Murray to serve an additional dwelling.

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
