#### The Site

The site defined in red on plan reference 01 represents the existing Commissioners' car park which sits opposite the Town Hall on the north western side of the Promenade at its south western end. There is an existing residential property immediately to the north east of the site and behind this, Creggan Beg, a complex of dwellings accessed from Creggan Mooar. To the rear is Creggan Mooar itself and the access to this from Bay View Road. To the south west there is the rear of a line of residential properties with permission having been granted at the south eastern end for two new dwellings (PA 05/92286, 05/1265 and 05/0558).

#### Planning Status

The site lies within an area designated on the draft Port St. Mary Area Plan as Car Park. This is referred to in the Written Statement at paragraphs 7.5 and 7.8 where it states: "Whilst the 1997

Town Centre Survey indicates that visitors to Port St. Mary consider the level of public car parking provision to be an important issue, it was not regarded as being notably deficient. Problems which were identified included the surfacing and arrangement of the Bay View Road car park..." and "THE DEPARTMENT WOULD ENCOURAGE THE IMPROVEMENT OF BAY VIEW ROAD CAR PARK, PRIMARILY BY WAY OF RE-SURFACING AND PARKING BAY MARKINGS." I assume the reference to Bay View Road is this car park, as there are no other significant car parks in the vicinity of Bay View Road.

### Planning History

There have been no applications submitted in respect of this site.

### The Proposal

Proposed here is the upgrading of the car park by way of the installation of lighting, planters and a new waste recycling bay. The existing car park is a rather random layout with a non-uniform surface and recycling bins in the centre. Proposed is a more structured layout of the car park with clearly defined spaces and planters for shrubs alongside the pathways leading to Creggan Mooar. Disabled persons spaces are also provided at the front end of the car park and an in and out system for traffic flow. Cobbles are proposed at the front end of the car park fronting onto the promenade. The whole car park is to be re-surfaced with bitmac.

The applicant has provided additional, amended plans which show planting rather than cobbles to be introduced at the front of the site.

### Representations

No views have been received in respect of this application.

### Assessment

The proposal will tidy up the car park and enable its more efficient and safer use. The introduction of planting at the front of the site will result in a much tidier and pleasing appearance and a clearer indication to approaching traffic of the routes in and out of the car park.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Disability Access Officer provides advice on matters which are the responsibility of the highways authority and as such should not be afforded party status in this instance.

The Manx Electricity Authority raise issues relating to working practices and as such should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the alterations to the car park as shown in drawings 01 received on 11th July, 2007 and 03A received on 24th September, 2007.

C 3. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.

N 1. The applicant is encouraged to consult the Disability Access Officer in respect of the widths of paths and parking spaces and to assure they are suitable for use by disabled persons.

N 2. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.

The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
