### Officer's Report

#### The Site

The site represents part of a larger undeveloped industrial plot located with Balthane Industrial Estate. The site lies on the south western side of the estate road as it enters the estate and runs towards Turkeyland Quarries which are some way to the east. The site, whilst undeveloped, has been the subject of two earlier applications for industrial development (see below).

## Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Existing Predominantly Industrial Use.

## Planning History

Planning permission was sought and granted on review for the erection of a factory/warehouse and associated facilities under PA 03/1108. Planning permission has recently been sought for the development of the north eastern quarter of the site under PA 07/1208, separate from the earlier overall scheme.

## The Proposal

Now proposed is the erection of a detached industrial unit with access from the estate road and car parking in front of the building. The building will be 9.2m in height and with a footprint of 30.5m by 22.5m which is slightly wider and 1m taller than the unit proposed on the plot to the north east but still lower than the building permitted under PA 03/1108.

The building will be finished in render, steel sheeting, colour to be determined.

## Representations

Department of Transport Drainage Division recommend conditions regarding sewerage.

Department of Transport Highways Division raise no objection subject to the omission of parking space number 7 to better facilitate vehicle movement within the site.

Malew Parish Commissioners indicate that they have no objection to the proposal.

The Manx Electricity Authority raise no objection subject to the attaching of a note regarding working practices around existing electricity supplies.

The Isle of Man Water Authority recommend that a note is attached regarding water supplies.

## Assessment

The proposed use is consistent with the land use designation and the form and design of the building is similar to that which is proposed on the site alongside and which has already been permitted on the site under an earlier application. There is sufficient space, even with the retention of parking space 7 to manoeuvre standard sized vehicles within the site. If larger vehicles use the site, then more than parking space 7 will be required to be relocated. These spaces as shown are in accordance with the Strategic Plan parking standards of one space per 50 square metres of industrial floor space.

## Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Isle of Man Water Authority and the Manx Electricity Authority raise issues associated with working practices during the development which are not material planning considerations and as such these parties should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the development of an industrial unit and associated parking as shown in drawing reference WL/07/1038/1 and the site and location plans all received on 19th July, 2007.

C 3. The proposed development must be connected to the main foul sewer.

NOTE: A Drainage Connection Fee will be payable to the Drainage Authority on this development

C 4. There must be no discharge of surface water to the main foul sewer.

C 5. The only processes which may be undertaken within the site are dry industrial processes only and the only discharges which will be accommodated in the public foul sewer are domestic sewage from WCs and canteens.

NOTE: The applicant is encouraged to consult the Department of Transport Drainage Division in respect of the above.

C 6. Prior to the use of any cladding, the colour of all cladding to be used in the development, including roofing, must be approved by the Planning Authority.

N 1. The Department of Transport Highways and Traffic Division recommends the omission of parking space nubered 7 in order to improve vehicular manoeuvrability within the site.

N 2. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.

The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.

For single connections to a water main (i.e. a single dwelling) the applicant should contact Isle of Man Water Authority Customer Services, telephone 695949.
