#### Site

The dwelling 17 Cleiy Rhennee, Kirk Michael is a two storey detached property located within a newly constructed residential cul-de-sac, which is adjacent to the Dismantled Railway Line (footpath).

#### Department Policies

The site has been zoned under the Kirk Michael Local Plan Order 1994 as being within an area of 'predominately residential' use; the site is neither within a Conservation Area, nor within an area zoned as High Landscape Value or Costal Value and Scenic Significance.

#### Proposal

The application proposes the erection of a conservatory on rear elevation. The conservatory would have a rear projection of 3.5 metres, a width of 5.5 metres and a maximum height of 3.5 metres.

## Representations

The Drainage Division makes no comment on the merit of the proposed development but request that an informative note be attached to any approval decision notice.

We have received no private representations objecting to the application.

## Assessment

The proposal will have little or no impact upon the neighbouring residential amenity particularly from overlooking which could result in a loss of privacy, due to the existing 1.8 metre high timber fence which runs along the eastern boundary of the site and because of the distance between the neighbouring properties.

For these reasons the proposal would seem appropriate in this location and therefore my recommendation is for an approval.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the submitted documents and drawing DWE 1427 all received on 27th July 2007.

C 3.

There must be No discharge of surface water (including that from roofs and paved areas) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.

The application states that the surface water from the proposed development is to be discharged to the "existing drainage". If this "existing drainage" discharges (directly or indirectly) to the foul sewerage system then it should be noted that an alternative means of surface water disposal must be provided.

I confirm that this decision accords with Government Circular Nos 44/05 (Delegation of Functions to Director of Planning and Building Control) and 47/05 (Delegation of Functions to Senior Planning Officer)
