## The Town And Country Planning (Development Procedure) Order 2005

In pursuance of his powers under the above Act and Order, the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by Nightech Limited for the construction of a single storey apartment on the roof above apartments No. 15, 16 and 17 and adjacent to apartment 22, Douglas Head Apartments, Douglas Head, Douglas, subject to compliance with the following conditions:-

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This permission relates to the construction of a single storey apartment on the roof as shown in drawing numbers P-01, P-02, P-03 and P-04 date stamped 31 July 2007, P-05 Rev 4 date stamped 4 December 2007 and the Planning Statement from McGarrigle and Jackson date stamped 31 July 2007.
3. Prior to the occupation of the apartment, details of the car parking arrangements shall be submitted to and approved in writing by the Planning Authority. Thereafter the parking facilities shall be provided in accordance with the agreed arrangement and remain available for use in conjunction with the approved apartment.

## Notes

1. The applicants should discuss fire safety related issues with the Fire Safety Department.
2. The applicants' attention is drawn to the 'Water Supply to Flats and Apartments Regulations' and if applicable to 'Form of Undertaking in Respect of Supply Pipes'. Copies of these documents can be obtained from Isle of Man Water Authority.
3. There are underground cables/overhead lines present in the area. The applicants should contact the Network Operations Department, Manx Electricity Authority (tel 687687) to discuss working practices around cables and overhead lines which may require to be diverted before any work can commence on the site.
