### Officer's Report

#### The Site

The site represents the curtilage of the semi-detached dwelling 4 Clybane Rise Douglas. The property is located towards the entrance of the cul-de-sac and is on the north side of the pair of houses, with no. 2 Clybane Rise to the south.

#### Planning Status

The site is located within an area identified as 'Predominantly Residential Use' by the Douglas local Plan. The site is not within a Conservation Area.

The Isle of Man Strategic Plan 2007, paragraph 8.12.1 states:

'As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such

extensions would not have an adverse impact on either adjacent property or the surrounding area in general.'

### The Proposal

Proposed here is a conservatory to be erected on the rear elevation of the property constructed from PVC on a brick plinth. The boundary treatment between the proposal property and the neighbouring property 2 Clybane Rise is to be brick.

### Representations

Braddan Parish Commissioners do not oppose this application. The Department of Transport Highways Division indicate no opposition to this application. The Department of Transport Drainage Division wish for a condition to be attached to any subsequent approval.

We have received no privately written representations in relation to this planning application.

### Assessment

It is considered that this proposal is in accordance with the general policy set out in Paragraph 8.12.1 of the Strategic Plan in that it would not have an adverse impact on either adjacent property or the surrounding area in general. The orientation of the proposed conservatory is such that it would not cause loss of light nor have an overbearing impact to No. 2 Clybane Rise.

The proposed treatment of the boundary with the neighbouring property was not made explicit by the submitted plans. The agent was contacted by telephone to clarify the proposed construction material and it was stated that he thought that it would be a brick wall. Written confirmation was requested in relation to this and on the 3rd October the agent confirmed by email that the boundary treatment would indeed be brick. This is considered to be an appropriate treatment in order to maintain an acceptable relationship with the neighbouring property and to ensure that there will be no direct overlooking to the rear garden of 2 Clybane Rise.

### Recommendation

It is recommended that this application is permitted.

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:
