## Officer's Report

## THE SITE

The site represents the curtilage of an existing dwelling - Seamount which lies to the south of Castletown and accessed from Scarlett Road which continues on to Scarlett Point. The property is a substantial two storey one with 5 downstairs rooms and seven upstairs. Also within the site is

Seafield Cottage which is also within the site which is in the process of being purchased by the applicants.

### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan). Order 1982 as of an Area of High Landscape or Coastal Value and Scenic Significance. The site has however immediately to the north and north west an area of Proposed Residential use. Part of the residential curtilage may fall within this. This land is referred to in the Castletown Local Plan of 1991 as "Future policy for this area is subject to Island Strategic Plan, Southern Sector (C) for the area including Malew. The Sector Plan which is no longer a material consideration, recommends at PROPOSAL S/RES/PRI "The area to the south west of Castletown in the Malew Part of Scarlett should be removed from residential use".

### Planning History

No planning applications have been submitted in respect of this site.

### The Proposal

Proposed here are alterations and extensions to the property in the form of a conservatory on the south eastern elevation, a garage on the north western elevation, a new entrance porch on the south western elevation and a new kitchen and utility room on the north eastern elevation. Upstairs there is to be a balcony above the conservatory, a bedroom, bathroom and gym above the garage. Three trees will be removed as a direct result of the proposed extensions with others to be removed as a general management exercise.

### Representations

Manx Electricity Authority suggest consultation regarding working close to existing electricity supplies. Malew Parish Commissioners indicate that they have no objection to the application.

The Society for the Preservation of the Manx Countryside and Environment indicate that the building is "quite exposed" and that they would hoping for a more impressive design, particularly bearing in mind the flat roofed conservatory and the low pitched roof over the garage extension.

Department of Transport Drainage Division recommend that the proposed sewerage system complies with Building Regulations and point out that the applicant must obtain a licence to discharge from the Environmental Protection Unit.

Fire Prevention Officer recommend the installation of domestic smoke detection.

### Assessment

Whilst the Society for the Preservation of the Manx Countryside and Environment is not encouraged by the design, the incorporation of the flat roofed conservatory with lantern lights is not in my view unattractive, particularly with the metal railing around the balcony. Their reference to a low pitched roof of the garage extension, I cannot find this on the drawings, other than a small canopy roof over the garage doors. The remainder of the scheme takes its lead from the existing roof pitches.

The existing building is not of particular architectural merit and the changes are not in my view adverse so as to warrant refusal of this application.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Society for the Preservation of the Manx Countryside and Environment is not directly affected by the proposal and should not be afforded party status in this case.

The points raised by the Fire Prevention Officer are the responsibility of the Building Regulations and as such should be addressed by way of a note. The Fire Prevention Officer should not as such be afforded party status in this instance.

Manx Electricity Authority make comments in respect of working practices around power supplies which is not a planning matter in this case.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the alterations and extensions shown in drawings reference 4099-LP, 4099-SK1, -SK2 and -SK6, 4099-4, -5, -6 and -8 all received on 11th June, 2007.

C 3. The external finishes of the extension must match those of the existing building in all respects.

N 1. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.

N 2. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.

The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.

N 3. The applicant should consult the Environmental Protection Unit of the DLGE in respect of a licence to discharge from the proposed sewerage system and also consult with the Building Control section of DLGE regarding Building Regulation approval for the proposed system.
