### Officer's Report

This application is a result of a previous refusal for the conversion of a dwelling into five self-contained apartments. The reason for refusal was "Whilst the conversion of the building to self contained apartments is generally acceptable, flat two would have a poor residential environment by virtue of the very limited (if any) outlook from the basement bedroom and a view from the ground floor outlet out onto the rear lane and rear yard which is accessible by other residents and used for bin storage". A note was attached to the decision notice indicate that the refusal was without

prejudice to the conversion of the building to four flats where the basement and rear outlet on the ground floor are used for communal facilities for the residents of the building.

This current application has re-arranged the layout of the building. The basement of the building will be used as a communal store. The ground floor of the rear outlet will not be communal space as suggested in the note to the applicant. Instead it will provide an additional bedroom to flat 2 which has its main living accommodation on the first floor of the building. The previous scheme had proposed having the main living space of a flat, i.e. living/dining room and kitchen, in the rear outlet. This arrangement is significant improvement on the previous application. All of the proposed flats have there living room looking out over Bucks Road. I consider the outlook from the apartments to be acceptable and would provide a satisfactory living environment.

The application also proposes to install a velux window and flat roof dormer to the property. I consider a rooflight to the front elevation would be acceptable as long it is a conservation style rooflight. This can be conditioned as part of the any approval for the scheme. The flat roof dormer to the rear, which is replacing a pitched roof dormer, is not ideal considering the site is within a Conservation Area. However, the window is set to the rear of the property and would not be visible from any public thoroughfares. I consider the dormer should have a pitched roof. I therefore propose a condition requiring the proposal to be amended to show a pitched roof. The use of a condition has been used a recent appeal to make the overall design of dormer window more acceptable within the context of street scene.

I therefore recommend that planning permission be granted subject to conditions.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst IoM Fire and Rescue Service and the IoMWA represents a statutory authority, the points raised in correspondence relate to Building Control matters and not planning and as such should not be afforded party status in this instance.

Disability Access Office has commented on the access arrangements for the building. These are Building Control matter and not planning matters and as such should not be afforded party status

C 1.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the conversion of a dwellinghouse into four self-contained apartments as shown in drawing numbers P01, P02, P03, P04, P05 and P06 date stamped 2nd May 2007.

C 3. The rooflight to be installed shall be a Conservation style rooflight.

C 4. The dormer window to the rear shall be constructed with a pitched roof in accordance with details which shall have first been submitted to and approved in writing by the planning authority.

N 1. The proposed flats must, on completion of the proposed works, comply with the requirements of the Housing (Flats) Regulations 1982 and be registered thereafter under the same Regulations.

N 2. The applicant is advised to consult the Fire Safety Department as the proposal may fall within the scope of the Fire Precautions (Flats) Regulations 1996.

N 3. The applicant is advised to consult the IoM Water Authority regarding the water supply to the proposed flats.
