### Officer's Report

#### Description Of Application Site

- The application site is the two storey terraced property of No.66 Murrays Road. The site is set on the northern side of Murrays Road.
- There is a single and two storey outrigger to the rear of the property.
- The application site is within a predominantly residential area.
- To the north west of the application site is the residential property of 68 Murrays Road.
- To the south east of the application site is the residential property of 64 Murrays Road.
- To the rear of the application site is a lane. On the opposite side of the lane is Murrays Road School

#### Proposal

- The applicant is seeking permission to demolish the existing single storey outbuildings and erect a garage and utility to the rear.

- The extension will project 5.1m to the rear and will be 5.9m in width. The extension will wrap around the two storey outrigger by 3.8m.
- The height of the extension will be approximately 2.8m.

- The occupiers of No. 64 Murrays Road have objected to the application on the ground of loss of privacy and loss of light.

### Issues
- In terms of the impact on No.64 Murrays Road, the application site is set to the North West of the neighbouring property. The existing boundary wall would remain in situ. The proposed works will not project above boundary wall. I consider the proposal will not cause any significant harm to the occupiers of No.64 from overshadowing and loss of light.
- The occupiers of No.64 are right to point out that the application indicates the flat roof will be to a specification suitable for recreational use. The occupiers of 64 are concerned about overlooking and loss of privacy. These were my concern in respect of the previous application which had a roof terrace. However, this application does not show any direct form of access onto the roof. Therefore the use of the roof would be difficult. In order to protect the privacy of the adjoining property I consider a condition should be attached stating the roof should not be used for recreational purposes.
- In terms of the impact on No.68 Murrays Road, the applications site is set to the south east of the neighbouring property. There are two windows on the rear elevation of the neighbouring property which serve a habitable room. The nearest window is set approx 500mm off the boundary. The existing boundary wall would remain in situ. The height of the existing wall is 2.2m along the boundary of No.68 Murrays Road. The proposal is to build a new outer leaf of the existing wall by 700mm which will increase the height of the wall to 2.9m. This section of wall would extend from the rear boundary wall to the rear elevation of the neighbouring property. This would mean that 8.5m of the existing boundary wall would become 2.9m in height. The boundary treatment will not have an overbearing impact and would not be visually intrusive when viewed from the rear yard and rear ground floor windows of No.68 Murrays Road.
- In term of overshadowing, the application site is set to the south east of the neighbouring property. The proposal would be on the northern side of the property. The proposal would cause very little impact in terms of overshadowing and loss of light. I therefore do not consider this to be a reason for refusal.

### Conclusion
I therefore recommend that planning permission be granted subject to conditions.

Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

It is considered that all parties who made representations to the planning application comply with the requirements of Planning Circular 1/06 – Determination of Interested Party Status
