### Officer's Report

THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a detached dwelling that is located in the South Cape area of Laxey. The proposed development comprises of alterations to the dwelling, the erection of a sun deck and the erection of a detached garage. PLANNING HISTORY

Whilst the application site has been the subject of previous planning applications it is considered that none of these are specifically material to the assessment of this current planning application.

REPRESENTATIONS The Department of Transport Highways Division do not oppose the planning application. The Isle of Man Fire and Rescue Service recommend the installation of smoke detectors.

The owners and/or occupants of Bay View, which neighbours the application site, express an interest in the planning application. Whilst they do not object to the proposed development they highlight the structural integrity of the lane.

The owner of fields 612011, 612008 and 614589, which neighbour the application site, express an interest in the planning application. Whilst they do not object to the proposed development they state their right of access along the lane.

### Planning Policy

The application site is within an area recognised as being within predominantly residential use under the Laxey and Lonan Area Plan Order 2005. Policy L/RES/PR/1 states:

"Residential development will generally only be approved within the study area in those areas designated as proposed and existing residential. In particular, in the case of Agneash no further dwellings will be approved although, as will be the case in areas zoned as residential, alterations and extensions to existing property may be accepted if such proposals are sympathetic to the character and appearance of both the building to be altered and the surrounding area in general."

### Assessment

The development proposed by the planning application comprises of three elements. Firstly, alterations to the external appearance of the dwelling. Secondly, the erection of a sun deck to the rear of the dwelling. Thirdly, the erection of a detached garage.

In terms of the first element it is considered that the impact of the proposed alterations are suitably limited and actually improves the visual appearance of the dwelling. In terms of the second element it is considered that, by reason of its location and extent, that the proposed sun deck will have little impact on the amenity of the surrounding properties. In terms of the third element it is considered that the proposed garage is domestic in scale and its impact on the surrounding area is suitably limited. Overall, it is considered that the development proposed by the planning application is in keeping with the character of the dwelling and has limited impact on the surrounding area. It therefore accords with policy L/RES/PR/1 of the Laxey and Lonan Area Plan Order 2005.

The issues raised by the two private representations relate to an issue that is not directly connected to the development proposed by the planning application. As such it is not a matter for consideration as part of this planning application.

It is recommended that the planning application be approved.

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

The Department of Transport Highways Division; The owners and/or occupants of Bay View; and The owner of fields 612011, 612008 and 614589.
