THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a detached dwelling located within the Booilushag estate in Maughold. The proposed development comprises of the alteration and extension of the dwelling. PLANNING HISTORY

The application site has not been subject of any previous planning application that is considered specifically material to the assessment of this current planning application.

REPRESENTATIONS

Maughold Parish Commissioners object to the planning application. The grounds for their objection can be summarised as concern that the increase in height is excessive and that the proposed development will be visually detrimental to the area. They suggest that the proposed development is contrary to Housing Policy 17 of the Revised Draft Strategic Plan of April 2007. This policy states:

"The extension of non-traditional dwellings or those of poor or inappropriate form will not generally be permitted where this would increase the impact of the building as viewed by the public."

The Department of Transport Highways Division do not oppose the planning application.

The Department of Transport Drainage Division do not oppose the planning application subject to conditions.

The Isle of Man Fire and Rescue Service recommend the installation of smoke detectors.

### Planning Policy

The application site is within an area of land designated as predominantly residential use under the 1982 Development Plan Order.

### Assessment

The planning application seeks approval for the extension and alteration of the dwelling, which stands within its own significant grounds at the northern end of the Booilushag estate. The site is relatively screened by existing trees and planting primarily along its north and north-western boundary.

The proposed development basically changes the form of the existing dwelling from a two-storey dwelling with a shallow roof pitch to a two-storey dwelling with a steeper roof pitch. This is tallied to a number of extensions to the dwelling including an extension above an existing single storey part of the dwelling, a new projecting two-storey bay, and a replacement attached garage.

Given that the dwelling exists and already has an impact within the area it is considered necessary, in terms of Housing Policy 17, to balance the design of the proposed development against the design of the existing dwelling. Similar to other dwellings within the Booilushag estate the existing dwelling is non-traditional in design and best described as being of its time. As such it is considered that the design of the proposed development represents a significant improvement over the design of the existing dwelling. Accordingly, notwithstanding the issue of what weight to attach to the emerging Strategic Plan, it is considered that the strict application of the policy would be unreasonable and inappropriate in this instance. Whilst the visibility of the dwelling will obviously increase as a result of the proposed development it is believed that the advantage from the improvement in appearance is greater than the disadvantage from its increased visibility. In other regards the isolation of the dwelling and its distance from neighbouring properties suitably limits the impact of the proposed development on residential amenity.

It is recommended that the planning application be approved.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to drawing no.s 01, 02, 03 rev. B and 04 rev. A date stamped the 17th April 2007.

C 3. There must be no discharge of surface water to the main foul sewer.

C 4. It is understood that public sewerage crosses the application site. The line of the sewer(s) must be identified before development work commences and the sewer(s) must be fully protected whilst all building works are being carried out.

N 1. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
