In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 13th June 2007, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

2. This permission relates to the extension of the garden of Gardenfield into the two areas edged in red on plan reference 07/15/01 received on 20th April, 2007.

3. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 (or any Order revoking or re-enacting that Order) no extensions, greenhouses, walls, gates, fences, garden sheds, summerhouses, flag poles, decking, garages, or tanks for the storage of oil for domestic heating shall be erected (other than those expressly authorised by this approval.)

4. The edge of the new garden area must be formed by new shrub and tree planting to complement that already existing around Gardenfield. Prior to the take up of the use of the new areas of garden, a landscaping and planting scheme must be approved by the Planning Authority and the planting introduced in accordance with that scheme prior to the use of the new areas as garden.

NOTE The effect of this permission will be to extend the garden of the existing property into the areas defined in the application and retaining the open aspect of the site and/or introducing new vegetation. No permission is hereby implied to the erection of any new structures in these areas and there is no presumption in favour of further dwellings in this area.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either;

- Any appeal has been determined;

Whichever is the later.
