### Officer's Report

#### The Site

The site represents the site of an on-going development of public car parking spaces and apartments situated between Kissack Road, Scarlett Road and Farrant's Way.

#### Planning Status

The site lies within an area designated on the Castletown Local Plan of 1991 and the draft Castletown Area Plan of 2001 as Residential and Proposed Residential respectively.

#### Planning History

There are two applications which were both permitted and are both still valid for this site: PA 04/2283 for 38 apartments and PA 03/0520 for 54 apartments. The development presently underway on the site is that permitted under PA 03/0520.

#### The Proposal

Proposed now is an amendment to the scheme to take account of the natural ground levels on site. The proposal involves raising the western end by 250mm and lowering the eastern end alongside Scarlett Road end by 450mm.

### Assessment

The end to be raised by 250mm is not adjacent to any other property and the amount by which the building is to be raised is imperceptible in the streetsce. It is only the end of the elevation - the lowest section - which is to be altered. On the other end, the end section is to be lowered, which can only have a positive impact. I would doubt whether the changes would have been noticeable if they had been implemented.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The points raised by the Fire Prevention Officer are the responsibility of the Building Regulations and as such should be addressed by way of a note. The Fire Prevention Officer should not as such be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the alteration of the levels of the two end blocks - as shown in drawings reference 20, 21A, 44, 45, 46 and 47 all received on 20th April, 2007, of the development otherwise to be undertaken in accordance with the provisions of PAs 03/0520 and 06/1655.

N 1. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.

I confirm that this decision accords with Government Circular Nos 44/05 (Delegation of Functions to Director of Planning and Building Control) and 47/05 (Delegation of Functions to Senior Planning Officer)
