# 07/00781/C Refusal Notice

## Town and Country Planning Act 1999

### Town and Country (Development Procedure) Order 2005

Miss P Newton
2 Glen View
South Cape
Laxey

In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

**Name:** KSi Hawk Ltd
**Proposal:** Change of use from residential to residential and office
**at:** The Rowans
Quines Hill
Port Soderick
Isle Of Man
IM4 1AU

which was considered on 19th July 2007, for the reasons set out below.

**Date of Issue:** 24th July 2007

**Murray House Mount Havelock Douglas**
*(Signature)*

**Deputy Secretary Planning Committee**
*(Signature)*

### Reasons For Refusal:

1. The proposed use would be contrary to the zoning of the area and would result in the creation of an office use on land not zoned or designated for such a purpose, contrary to the provisions of Planning Circular 6/91 Braddan Parish District Plan and The Isle of Man Strategic Plan Business Policy 7.

2. The visibility from the existing driveway is inadequate and does not provide adequate stopping sight distance. Works suggested to improve visibility relate to land outside the ownership or control of the applicant and as such it is considered that the proposed increase in use of the property would be detrimental to all users of the adjacent highway.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

A form and guidance notes are available from either the Planning Office, Tel 685950, or to download from the Department's website www.gov.im/dlge/planning/plan
