#### Site

- The application site is an end of terrace dwellinghouse on the corner of Drury Terrace, which fronts onto Ballaquayle Road, and Princes Avenue.
- The site is within an area zoned as predominantly residential.
- The site is within a Conservation Area.
- To the southeast of the application site is the public highway of Princes Avenue
- To the northeast of the application site is the public highway of Park Avenue

### Assessment
- Section 18 (4) of the Town and Country Planning Act 1999 states that "Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing it character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act.
- Environment Policy 35 of the emerging Strategic Plan (April 2007) states that "Within a Conservation Area, the Department will permit only development which would preserve or enhance the character and appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
- The key issue in the assessment of this application is the impact on the character and appearance of the Conservation Area and the street scene.
- The properties within Drury Terrace have dominant chimneys which add character to the overall appearance of the building. The same can be said about the properties on Princes Avenue and other the properties which front onto Ballaquayle Road.
- The demolition of the chimney stack at application would significantly alter the character and appearance of the building. The wall of the property, which contains the chimney is fully exposed to view from Ballaquayle Road and Princes Avenue. In my view to allow the demolition of the chimney would enhance the appearance of this building when viewed from Ballaquayle Road. The removal of the chimney stack would allow the corner feature of the property become the more prominent within the street scene compared to overly dominant chimney stack. I therefore consider in this case the removal of the chimney stack would be more beneficial to the overall character and appearance of the Conservation Area.

### Recommendation
I therefore recommend that planning permission be granted subject to conditions.

### Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
