### Officer's Report

This application is seeking permission for amendment to an approved development scheme. In summary the changes are as follows:

#### Block A:

- changes to the window opening and style
- Minor change in the roof design
- Use of pitched roof dormers instead of flat roof dormers
- Removal of the first floor balconies.

Block B:
- changes to the window opening and style
- Minor change in the roof design
- Increase in height of the MEA sub-station.

Block C:
- changes to the window opening and style
- Minor change in the roof design
- Use of pitched roof dormers instead of flat roof dormers
- Minor changes to the main entrances to the buildings

The internal alterations involve the provision of a communal bin store and the re-arrangement of the internal layout of the flats.

I consider the proposed external alteration will not adversely affect the visual amenities of the street scene. I therefore recommend that planning permission be granted subject to conditions.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst IoM Fire and Rescue Service and IoM Water Authority represents a statutory authority, the points raised in correspondence relate to Building Control matters and not planning and as such should not be afforded party status in this instance.

The Disability Access Office has raised issues relating non-planning matters and as such should not be afforded party status.

C 1.

This permission relates to the external and internal alterations to approved sheltered housing development as shown in drawing numbers 210 Rev B, 12, 302, 301, 300, 110 Rev L, 111 Rev F, 112 Rev F, 120 Rev F, 121 Rev F, 122 Rev F, 100 Rev G, 101 Rev G and 102 Rev G date stamped 14th March 2007.

C 2.

The proposed accommodation may be occupied only as sheltered housing; prior to such occupation, there must be submitted to and approved by the Planning Authority details of the occupancy constraint and the mechanisms for enforcing these.

C 3.

Any Permitted Development Order for the time being in operation will not apply to this site.

C 4.

No unit may be occupied until such time as the parking areas and associated access routes and turning areas have been completed and are available for use.

C 5.

No water or contaminants from the site shall be permitted to flow or be tracked on the highway.

C 6.

All services must be laid underground, and all soil stack must be constructed internally.

C 7.

Within 2 months from the date of this decision notice a scheme of soft landscaping shall have been submitted to and approved in writing by the planning authority. All planting shall be carried out in accordance with the approved details in the first planting and seeding seasons following that first occupation. Any tree or shrub which within 5 years from the completion of the development dies, is removed or becomes seriously damaged or diseased shall be replaced in the next planting season with another of similar size and species, unless the planning authority gives written consent to any variation.

C 8.

No existing tree or shrub indicated on the approved plans to be retained shall be cut down, grubbed out, topped, lopped or uprooted without the written consent of the planning authority. Any such tree or shrub which within 5 years ~~removed~~ without such consent or dying, becomes seriously damaged or diseased within a period of 5 years from the completion of development shall be replaced in the next planting season with another of similar size and species, unless the planning authority gives written consent to any variation.

N 1.

For water connections that comprise more than a single connection to a water main or service, or where new water mains and hydrants will be required, the applicant should contact the Isle of Man Water Authority Planning and Projects Section, telephone 695958.

N 2.

The applicant is advised to consult with the Fire Safety Department as the proposal falls within the scope of the Fire Precautions (Flats) Regulations 1996.
