## Officer's Report

### The Site

The site represents the curtilage of The Bay Queen Hotel, a Registered Building located on the eastern end of Port St. Mary Promenade between two pairs of semi-detached houses to the east and modern apartments and the terrace of guest houses to the west. The site accommodates the former hotel, part of which has been demolished in preparation for the scheme of extension, new building and conversion to apartments which has permission. the site has to its rear number 32, 33 and 34, Rhenwyllan estate.

### Planning Status

The site lies within an area designated as Predominantly Tourist Accommodation on the 1982p. On the draft Port St. Mary Area Plan of 2001 which proceeded as far as a public inquiry and Inspector's report, but no further, as Mixed Use (Residential and Office).

### Planning History

Various planning permissions have been secured for the redevelopment of the site, incorporating the retention of the Bay Queen Hotel itself, most lately under 02/0343, 02/1632, 05/0419, 05/1883 and 06/0248. The temporary siting of a portacabin was permitted under 04/1751.

### The Proposal

Proposed here is the use of part of the site behind the hotel building as a temporary builder's compound. The site has been temporarily fenced off and materials stored on site. The compound is not associated with the works on site, hence the application.

### Assessment

The hotel is Registered (reference RB 183) and the site is a prominent one which is calling out for development. Presently the site appears neglected and bare which is not appropriate either for a prominent seaside location or one which accommodates a building of acknowledged importance. The site is also overlooked by residents both on the promenade and from Rhenwyllan estate. The use of part of the site as a building compound unrelated to the site or works which have approval is totally unacceptable in terms of the resultant appearance and the nature and impact of the type of traffic generated from this use up and down a promenade where tourists are encouraged to stay and where tourists and locals alike may come for recreation and leisure purposes.

If the use has not ceased, appropriate enforcement action should be taken to require the site to be cleared as soon as possible, I would suggest within two weeks of the date of the notice as it becomes final.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

All those who have submitted views are directly affected by the proposal by virtue of overlooking the site or being affected by the traffic generated by the proposed use. As such they should all be afforded party status in this instance.

The use of part of the site as a building compound, unrelated to the site or works which have approval thereon is totally unacceptable in terms of the resultant appearance of the site, which accommodates a Registered Building and which is overlooked by other residential property and the nature and impact of the type of traffic generated from this use up and down a promenade where tourists are encouraged to stay and where tourists and locals alike may come for recreation and leisure purposes.
