### Officer's Report

#### The Site

The site represents the domestic curtilage of an existing property located within Ballanoa Meadow, a relatively new estate on the western side of the A25 Castletown Road at Newtown. The property lies at the eastern end of the first cul de sac within the estate. The property is a semi-detached two storey house which has been the subject of previous, recent proposals for extension (see below).

#### Planning Status

The site lies within an area designated as Proposed Residential on the Isle of Man Planning Scheme (Development Plan) Order 1982.

#### Planning History

Planning permission was granted on appeal for the estate under PA 99/0590. This particular dwelling was then the subject of PAs 06/0622 (refused) and PA 06/1606 (permitted) for extensions.

#### The Proposal

Now proposed is the erection of a conservatory in addition to the extensions already approved (see above). The extension will be 3.8m long and 3m wide and it is to be built within 0.25m of the boundary with number 11. The proposal for extensions under PA 06/0622 was refused as it was

considered to have a detrimental impact on the amenities of number 11: this proposed included an extension which would have been over 7m long alongside the boundary with number 11 and within 0.8m of the boundary. This conservatory is therefore closer, but a little over half the length of the previously refused extension and 0.8m lower. The conservatory will also be principally finished in glass with a low rendered wall compared with the solid masonry walling of the previously refused extension, thus further reducing its impact.

### Assessment

There are no objections to the proposal and it is significantly smaller than that previously refused. Whilst it is unfortunate that given the width of the site, the applicant has proposed something so close to the boundary with the adjoining property, however, the garden of number 11 is relatively large and they themselves have permission for significant extensions, albeit on the northern side of the garden (05/00537/B). Bearing in mind that the conservatory will be mainly glazed and could, had the property not been extended, have been built in this position with a similar impact, I consider this proposal to be acceptable.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
