### Officer's Report

THE APPLICATION SITE AND PLANNING APPLICATION The application site comprises the curtilage of a detached dwelling located on Summerhill in Onchan. The planning application seeks approval for the additional use of the dwelling as holiday accommodation. PLANNING HISTORY There are no previous planning applications that are considered material to the assessment of this current planning application. REPRESENTATIONS Onchan District Commissioners recommend that the planning application be approved.

The Department of Transport Highways Division do not oppose the planning application and express the opinion that the proposed use is likely to generate less traffic than use as a permanently occupied dwelling.

The Department of Tourist and Leisure Registration and Grading Commission support the planning application.

The Isle of Man Fire and Rescue Service recommend that the applicant consult them to discuss the provision of appropriate fire precaution measures.

The Isle of Man Water Authority requests that an informative note be attached to any approval decision notice.

The owner of 6, 8 and 10 Summerhill Road objects to the planning application. The grounds for their objection can be summarised as concern that there is insufficient car parking to cater for the proposed use.

The owner of 12/14 Summerhill Road objects to the planning application. The grounds for their objection can be summarised as concern that there is insufficient car parking to cater for the proposed use and that the additional use will generate undue noise nuisance.

### Planning Policy

The application site is within an area recognised as being within predominantly residential use under the Onchan Local Plan.

Policy O/TRT/P/3 of Planning Circular 1/2000, the written statement to be read in conjunction with the local plan, states:

> "The provision of tourist accommodation may be permitted within the study area where this is either:
> - In built-up areas where this will not cause nuisance or disturbance to adjacent residents or
> - In rural areas where the development will not result in an adverse impact in terms of the visual impact, traffic, noise or demands upon existing infrastructure. Where tourist accommodation is to be provided in addition to an existing or proposed permanent residential use, adequate additional car parking will be required in proportion to the amount of additional tourist bedspaces to be provided."

### Assessment

The planning application seeks approval for the additional use of the dwelling as holiday accommodation. The dwelling is a modest sized property containing two bedrooms.

The dwelling does not have any on-site car parking provision and there are double yellow lines immediately outside the property. It is reasonable to assume that occupants of, and visitors to, the dwelling park in the surrounding streets such as Alberta Drive.

In terms of impact it is considered that the use of the dwelling as holiday accommodation is unlikely to be significantly different to that of the existing use as a permanently occupied dwelling. Traffic generation may even be less than the present use as multiple car ownership for tourists and visitors to the tourist occupants are unlikely. There are no justifiable reasons why tourists occupying the dwelling should present any more of a noise nuisance than permanent occupants. Overall it is considered that the impact of the proposed use is not significantly different that of the present use.

It is recommended that the planning application be approved.

### Party Status

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

- Onchan District Commissioners;
- The Department of Transport Highways Division;
- The owner of 6, 8 and 10 Summerhill Road; and
- The owner of 12/14 Summerhill Road.

It is considered that the following parties that made representations to the planning application do not meet the criteria of Government Circular 1/06 and should not be afforded interested party status:

- The Department of Tourist and Leisure Registration and Grading Commission;
- The Isle of Man Fire and Rescue Service; and
- The Isle of Man Water Authority.
