### Officer's Report

#### The Site

The site represents a field situated on the southern side of the A7 between Colby and Ballabeg. The field stretches south from the A7 and reaches the steam railway line.

#### Planning Status

The site lies within an area designated on the Arbory and East Rushen Local Plan as an Area of High Landscape or Coastal Value and Scenic Significance.

#### Planning History

No applications have been submitted in respect of this site. Other applications have been submitted for other accesses and works in the Colby-Ballabeg area (PAs 07/0207, 0209, 0210 and 0334).

#### The Proposal

Proposed here is the improvement of the access. The applicant is the Isle of Man Water Authority who would like to establish a compound on this field in conjunction with a significant network

improvement programme which is due to commence in April to October 2007. The compound itself does not need planning permission under Class 5 of the Town and Country Planning (Permitted Development) Order 2005 provided that the site is restored within 12 months of the establishment of the facility.

The works themselves involve raising the level of the entrance and re-surfacing to raise the level of the driver of an emerging vehicle to provide visibility splays to the satisfaction of the Department of Transport, who, however have objected to the proposal on the basis that the visibility of 2m by 80m should be provided in accordance with the prevailing speed limit.

### Assessment

Regardless of the Authority's intentions to use the site as a temporary compound, the works to improve the safety of the entrance are to be welcomed. The access is on a fast stretch of the A7 which is not speed-restricted. The works themselves are minimal and will not have any adverse visual impact.

However, the Department of Transport have required that the visibility to be afforded is 2m by 80. The Water Authority has indicated that during the works there will be a temporary speed limit which will reduce the speed for traffic to 30mph which will bring down the requirement for the splays and which may be achieved by taking down the pillar and lowering the wall. This will be reinstated once works are completed.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Manx Electricity Authority raise issues relating to working practices around existing services which are not generally regarded as material planning considerations and as such the Manx Electricity Authority should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the alterations and improvements to the access as shown in drawings reference CAR/CA7/001/A, CAR/CA7/001/B and the photographs all received on 5th February, 2007.

The gate pillar and alterations to the wall must be re-instated once the water main improvement works are complete and the compound is no longer used by the Isle of Man Water Authority.
