### Officer's Report

#### Site

- The site is located 400m north of the New Castletown Road (A5) and adjacent to the Mount Murray Golf Course, which is set to the west of the site.
- The site currently comprises of a single storey building, a 10m monopole (used by Manx Telecom) with an equipment cabin.
- The site is zoned as a transmitter site within the Isle of Man Planning Scheme (Braddan Parish District Local Plan) 1991.
- The site is believed to have accommodated at 61m high tower in the past in which the foundations are still in situ.
- The surrounding area is zoned as open space (agricultural) and designated

The access track to the application site is a public footpath.

### Proposed Development

- The application is proposing to install four equipment cabinets and ancillary works to support the temporary pump up masts.

- Braddan Parish Commissioners have not commented on the application.
- Highways Division of the Department of Transport do not oppose the application.
- IoM Fire and Rescue Service recommend that the applicant consults the Fire Safety Department to discuss the Fire Precautions in connection with this application.

### Assessment

- The application is proposing to install equipment cabinets and ancillary work to support the temporary pump up masts, which have recently been granted planning permission.
- The proposed use accords with the land use zoning in the Braddan Local Plan 1991. I therefore consider the principle of the development to be acceptable.
- The proposed cabinets will be located within an existing compound area where other buildings and cabins exist.
- The proposed equipment cabinets are of standard design and size. The plans indicate the cabinets will be colour coated to further reduce its impact on the visual amenities of the area. I consider a condition requiring details of the colour coating would be appropriate to help reduce the impact of the cabinets within the locality. In my opinion the cabinets will not adversely affect the visual amenities of the locality.

### Recommendation

I therefore recommend that planning permission be granted subject to conditions in the attached schedule.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst IoM Fire and Rescue Service represents a statutory authority, the points raised in correspondence relate to Building Control matters and not planning and as such should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of equipment cabinets and ancillary works to support two temporary up masts as shown in drawing numbers DO.E_-01613 Sh 1 of 1 and DO.P2-26835 1of 1 Rev 2 date stamped 6th February 2007, Letter from Ian Hewitt Associates date 3rd February 2007.

C 3. Prior to the installation of the equipment and ancillary works, a letter notifying the date of installation shall have been submitted to the planning authority. Thereafter, the cabinets and ancillary works hereby permitted shall be removed from the site within 12 months of the date of installation, as notified to the planning authority.

N 1. The applicant is recommended to consult the Fire Safety Department of the IoM Fire and Rescue Service to discuss fire precautions in connection with this application.
