### Officer's Report

#### The Site

The site represents the curtilage of Rushen Primary School, situated on the north eastern corner of Four Roads (the junction of the A5 Castletown and the A29 Church Roads). The site accommodates the primary school and associated playing facilities and parking.

#### Planning Status

The site is designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Primary School.

#### Planning History

Various planning applications have been submitted in respect of the site for alterations, modernisation, reorganisation and extension of the school.

#### The Proposal

Proposed now is the creation of a covered waiting area to the east of the school buildings but within the site. The structure is to be just over 7.5m by 3m and 2.7m in height and in appearance rather like

a typical bus shelter. The shelter will be level with the playground and as such accessible by disabled persons.

### Assessment

The shelter will provide much needed sheltered waiting facilities and will not have any detrimental impact on the appearance of the site.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Fire Prevention Officer raises issues relating to the Fire Precautions Act which is legislation separate from the planning process and as such the Fire Prevention Officer should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a sheltered waiting area as shown in drawings reference CAP 03 and -04 both received on 9th February, 2007.

N 1. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
