### Officer's Report

#### The Site

The site represents the curtilage of Rushen Primary School, situated on the north eastern corner of Four Roads (the junction of the A5 Castletown and the A29 Church Roads). The site accommodates the primary school and associated playing facilities and parking.

#### Planning Status

The site is designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Primary School.

#### Planning History

Various planning applications have been submitted in respect of the site for alterations, modernisation, reorganisation and extension of the school. PA 07/0253 sought permission for the erection of a free-standing shelter for those waiting for the bus within the school grounds.

#### The Proposal

Proposed now is the erection of a shelter attached to the eastern end of the northern block on the site. The canopy will have a symmetrically curved roof finished in polycarbonate supported by a

structural steel frame and will extend by 10.8m from the end of the building to which it will be attached.

### Assessment

The canopy is unlikely to be seen at close range other than by those on the school site and for whom the canopy will provide welcome shelter in periods of inclement weather.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Fire Prevention Officer raises issues relating to the Fire Precautions Act 1975 which is legislation separate from the planning process and as such he should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a canopy as shown in drawings CAP/01, -02 and -05 all received on 9th February, 2007.

N 1. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
