## THE APPLICATION SITE AND PROPOSED DEVELOPMENT

The application site comprises the curtilage of a recreation area on the southern side of the Glen Road, Laxey.

The proposed development comprises of the refurbishment of the existing double tennis court, creation of a second doubles tennis court and the installation of children's play equipment.

## PLANNING HISTORY

Whilst the application site and surrounding area has been the subject of a number of previous planning applications it is considered that none of these are specifically material to the assessment of this current planning application.

REPRESENTATIONS The Department of Transport Highways Division do not oppose the planning application. The Department of Transport Drainage Division have no objections to the planning application.

The Department of Agriculture, Fisheries and Forestry's Inland Fisheries Development Manager have no objection to the planning application provided that a minimum of 8 metres is maintained between the development and the adjacent watercourse.

The Disability Access Office has expressed interest in the planning application and recommended that the needs of disabled access be taken into account.

## PLANNING POLICY

Under the Laxey and Lonan Area Plan Order 2005 the application site is zoned as open space (recreational). The site is also located within a Conservation Area.

### Assessment

The planning application proposes alterations to recreation equipment within a designated recreational area. As such the proposal is considered to be unobjectionable.

The concerns of the Inland Fisheries Development Manager are noted but given the form of the development it is considered unnecessary to restrict development in accordance with their request.

It is recommended that the planning application be approved.

### Party Status

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

- The Department of Transport Highways Division;
- The Department of Transport Drainage Division; and
- The Department of Agriculture, Fisheries and Forestry’s Inland Fisheries Development Manager.

It is considered that the following parties that made representations to the planning application do not meet the criteria of Government Circular 1/06 and should not be afforded interested party status:

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to drawing no.s 1, 2, 3 and 4 date stamped the 19th February 2007.

N 1. The applicant is advised that under section 35 of the Land Drainage Act 1934, written consent is required from the Department of Transport for any work carried out on any watercourses throughout the Island. It is strongly recommended that the applicant contact the Drainage Division before work commences on site to discuss the proposed work on the riverbanks.
