### Officer's Report

#### The Site

The site refers to the domestic curtilage of an existing dwelling situated on the northern side of Fistard Road. The property lies at the south western side of the site with a space to the east between the house and the neighbouring property.

#### Planning Status

The site lies within an area designated as Residential on the Isle of Man Planning Scheme (Development Plan) Order 1982.

#### Planning History

Planning permission was sought and refused for the creation of a parking bay under PA 06/1858. This proposal failed to make provision for visibility for those in vehicles emerging from the site.

#### The Proposal

This application proposes a similar parking facility to that proposed in the previous application but overcoming the objections thereto. The application differs from the previous one in that the boundary walls beside the access are to be lowered to afford visibility over them for drivers emerging from the site. The Department of Transport also suggest in pre-application advice that there should be a traffic mirror installed opposite the access although this would involve the use of land which is not within either the defined site or the control of the applicant so cannot properly be required by condition. The

applicant has confirmed however that he has the permission of the landowner in question and as such a note may be attached recommending the installation of such a mirror.

The Department of Transport also require the provision of a dropped kerb which may be required by condition as this represents work within the highway which does not need permission as it would be undertaken at the instruction of and on behalf of the Department of Transport, as Permitted Development.

Finally, there is presently a post box in the wall which is to be lowered. If the wall is lowered to the height required by the Department of Transport (that is, 1m) the post box would be too low to be useful. The applicant has liaised with the Post Office who have no objection to its being removed.

### Assessment

The scheme would now provide off-street parking and would not adversely affect pedestrian or vehicular safety.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the creation of a new parking area and access as shown in drawings 1 and 2 received on 23rd February, 2007.

C 3. In addition to the works shown and described in the approved plans, the roadside walls fronting the site must all be lowered to a height not exceeding 1m to allow visibility for those in vehicles emerging from the new parking facility.

C 4. The development must include the provision of a dropped kerb across the new access.

The applicant should liaise with the Operations Section of the Department of Transport in respect of this and working within the highway.

N 1. The applicant is advised to liaise with the Post Office regarding the post box which is presently in the wall which is to be reduced in height.

N 2. The applicant is recommended to have installed a traffic mirror on roadside opposite the proposed access to enhance visibility for those in vehicles emerging from the new parking space.
