### Officer's Report

#### The Site

The site represents the residential curtilage of an existing dwelling situated on the corner of Ballafurt Road and road (Balnahowe Road) which leads from Port Erin to The Howe and Cregneash. Also defined in blue is land also owned by the applicant, stretching further up towards Balnahowe.

#### Planning Status

The site lies within an area designated on the Port Erin Local Plan of 1990 as Residential. The area edged blue is within a wider area of Open Space.

#### Planning History

There has been only one recent application for works to the dwelling and works to create a garage and access to the north of the house, within the area of Open Space. This application, PA 06/0182, was refused.

### The Proposal

Proposed here is the replacement of the existing castellated porch with a half-glazed timber framed one with a pitched roof, the upward extension of the garage annex to provide a third bedroom with the installation of two new windows in the front (eastern) elevation and two in the side facing The Darrag. There is already a very small bedroom window in this side of the property, albeit 5.3m further into the site than will be the two new windows in the new roadside gable.

### Assessment

Whilst there is an objection from the occupant of Myrtle Cottage, The Darrag, (which does not bear the appropriate application reference of this application) this property is immediately behind (to the south east) of the main house and on the side where there are to be no alterations. The objection suggests that the proposed extension will totally obscure the views of Bradda Head and will block out natural daylight and sunshine to their property. I do not understand this objection as the proposed works are on the other side of the main house and probably will not be visible from Myrtle Cottage as it will be hidden by the existing main dwelling which is higher and wider than the extension. The objection also refers to conversion of the garage which is not proposed in this application.

The alterations to the property are very similar to those in the previous application except the garage is no longer to be converted (perhaps this is from whence the suggestion by the objector emanates). It was suggested in the previous application that the conversion of the garage may lead to the erection of a further garage which in itself may not be acceptable and as such the conversion of the garage is not being proposed in this application.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Fire Prevention Officer raises issues relating to fire safety of a domestic dwelling which is not a material planning consideration.

The occupant of Myrtle Cottage is immediately adjacent to the property and whilst I do not consider that there will be any adverse impact from the proposal on this property, they should be afforded party status in this instance.
