Site

The application site Ballanea Farm, Kirk Michael is located on the southern side of the A4 road and is south of Kirk Michael Village.

Land Use Zoning / Policy

The application site is within an area recognised as being an area of white land not zoned for development, under the Isle of Man Development Plan Order 1982. The site is not within a Conservation Area, however is within an area zoned as high landscape value or costal value and scenic significance.

The application proposes the erection of a steel portal framed cattle shed. The shed would have a width of 45.8 metres, a depth of 13.4 metres and a maximum height of 5 metres. The proposed barn would be sited north of the existing approved shed and west of cattle shed & hay store.

### Assessment / Recommendation

The applicant has submitted a written statement which addresses the justification for the proposed barn. In this statement the Applicant states that the farm is run as a Manx Organic Farm, which over the last 10 years have increased their cattle herd to 200 (cows, calves, yearlings and finishing cattle). The proposed barn is required so that the herd can be stored during the winter months. The existing barn which was granted an approval (02/00844/B) would carry on being used as a house to store cattle, with the old barn located to the east of the proposed barn would be used for the isolation of animals for various reasons including ill health and calving difficulties.

### Recommendation

The following policies must be taken into consideration when determining the application:-

#### General Policy 3 states:-
Development will not be permitted outside of those areas which are zoned for development on the appropriate Area Plan with the exception of:-
- (f) building and engineering operations which are essential for the conduct of agriculture or forestry.

#### Environment Policy 18 states:-
New buildings in the countryside including agricultural buildings must be sited as close as practically possible to existing building groups and be appropriate in terms of scale, materials, colour and siting and form to ensure that all new developments are sympathetic to the landscape and built environment of which they will form a part. Only in exceptional circumstances will buildings be permitted in exposed or isolated areas or close to public highways and in all such cases will be subject to appropriate landscaping. The nature and materials of construction must also be appropriate to the purpose for which the building is intended.

The proposed shed is a substantial size, however the building has been located within a group of existing farm buildings and therefore although a substantial size I do not consider the shed would have a significant adverse visual impact upon the surrounding countryside to warrant a refusal on these grounds. I am of the opinion that if the application is approved conditions should be attached for samples of the materials proposed to be used to be submitted for approval by the Planning Authority and a landscaping scheme be submitted to provide a natural screen along the western side of the proposed barn.

I therefore consider the proposal to comply with General Policy 3 & Environment Policy 18 as the proposal is justified and is sited within an existing group of agricultural buildings. For these reasons the proposals would seem appropriate in this location and therefore my recommendation is for an approval.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the submitted documents and drawing 3462-01 all received on 19th January 2007.

C 3. Prior to any works on the proposed dwelling, there must be submitted to and approved by the Planning Authority detailed drawings, showing a suitable scheme for adequate planting along the west boundary of the proposed barn; the approved scheme must be implemented during the first planting season following the commencement of the development.

C 4. The building must only be used for agricultural purposes.

C 5. Prior to the commencement of any works, there must be submitted to and approved by the Planning Authority samples of the materials to be used for external cladding of the walls and roof panels.

I confirm that this decision accords with Government Circular Nos 44/05 (Delegation of Functions to Director of Planning and Building Control) and 47/05 (Delegation of Functions to Senior Planning Officer)
