## Department of Local Government and the Environment ### Memomandrum To: Ian McCauley, Director of Planning and Building Control From: Ian Brooks, Planning Officer 11 May 2007 #### Compliance with Conditions: PA06/02164/B – Installation of a 13m high imitation cypress tree mast with associated equipment cabinets, Part of Field 624528 SW of Albert Tower Mountain Road To consider the submission of details in accordance with Conditions 5, 6 & 7 of Planning Permission 06/02060/B dated 19th March 2007. Condition 5 stated: > “Prior to the erection of the stock proof fencing, details thereof shall have been submitted to and approved in writing by the planning authority, and those works shall be carried out in accordance with the approved details.” The applicant has now provided detail drawings relating to the stock proof fencing. I consider the details to be acceptable and I therefore recommend that Condition 5 be discharged. Condition 6 stated: > “Prior to the construction of the Gabion wall, samples of the stone to be used shall have been submitted to and approved in writing by the planning authority and those works shall be carried out in accordance with the approved details”. Since the conditional approval, the applicant has commissioned a soil investigation survey at this site. It has turned out that not far underneath the surface of the field is actually solid rock. The applicants are intending to fill the gabion walls with the natural rock from the site. I consider this approach to be acceptable and would appear more natural in the landscape. I therefore recommend that Condition 6 be discharged. Condition 7 stated: > “Prior to the commencement of works, full details of a landscaping scheme shall have been submitted to and approved in writing by the planning authority, and those works shall be carried out as approved. All planting shall be carried out in accordance with the approved details in the first planting and seeding seasons following that first occupation of the site. Any tree or shrub which within 5 years from the completion of the development dies, is removed or becomes seriously damaged or diseased shall be replaced in the next planting season with another of similar size and species, unless the planning authority gives written consent to any variation.” The landscaping will be plant along the boundaries of the site. It is proposed to plant Hawthorn, Blackthorn and gorse along these elevations to conceal the compound. I consider the details to be acceptable and I therefore recommend that Condition 7 be discharged.
