### Officer's Report

#### The Site
The defined application site forms an area of land east of the A27 Dalby Road and is locate don land that rises from the road in an easterly direction. At the present time the land is in use as general pasture land.

#### Planning Status
The site is located just within an area identified as High Landscape Value and Scenic Significance in the 1982 Development Plan Order.

#### Planning History
There have been no previous applications in relation to the property that are considered relevant to this application.

#### The Proposal
The application proposes the construction of a single storey dwelling to be occupied by an agricultural worker (the applicant's son). The property would be accessed from the farm lane and be adjacent to and across from the farm yard and existing farmhouse which is occupied by the applicant and his family who operate the farm.
The dwelling proposed would be constructed with pitched slate roof and rendered walls and provide accommodation in the form, of three bedrooms, kitchen/dining room, dining room, lounge and office. No accommodation is proposed within the roof area.

#### Representations
The Department of Transport Highways Division advise of no objection subject to the provision of off street parking. Patrick Commissioners advise of no comment other that the property should be tied to the farm.
The SPMCE object to the principle of the development, together with the size and design. The MEA and Isle of Man Water Authority advise of standard notes. The Chief Fire Officer requests mains connected smoke detectors.

#### Assessment
Evidence has been submitted by the applicant and confirmed by the Department of Agriculture, Fisheries and Forestry that the farm, which extends to 430 acres (160 of which are owned), 37 acres of crops, 115 suckler cows and followers and 410 ewes and replacements requires a labour requirements of 3.32 labour units. The farm is run by Mr and Mrs Clague (the applicants) and their son for whom they are seeking approval to build a dwelling.
The Agricultural Advisor for the Department of Agriculture, Fisheries and Forestry strongly supports the application for the dwelling.

Planning Circular 2/88 New Agricultural Dwellings, advises that "A person who wishes to build a farm dwelling in a rural area must produce evidence to prove need sufficient to offset the general planning objections to such development". It is considered that such a need has been demonstrated in this application.

Since the time of the initial submission, the applicants have amended the siting of the dwelling so that it would now be constructed adjacent to the farm yard and close to the existing farmhouse. Existing buildings within the farm that may be suitable for conversion are currently being used in association with farming, and the site chosen takes its access from the farm lane which is the sole access into the unit.

With regard to the positioning and design of the dwelling, the site is elevated above the road, but not visible from the road, due to the steep gradient. The dwelling would be visible in wider views from the coastline and Raad ny Foillan, as is the existing, relatively modern dwelling on the site. With regard to design, it is considered that the dwelling represents a modern version of a Manx cottage and is considered acceptable.

### Recommendation

It is recommended that the application be approved subject to an occupancy condition.

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:

C 1.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to Drawing Numbers 06/2169/01; 02; 03, submitted as part of this application and date stamped 18th December 2006.

C 3. The occupation of the proposed dwelling(s) must be limited to persons whose employment or latest employment is or was in agriculture in the Island and including the dependants of such persons as aforesaid.

C 4. All plumbing stacks must be constructed internally.

C 5. The roof(s) must be finished in dark natural slate.

N 1. The applicant is advised to consult with the Manx Electricity Authority to determine the clearance required from the (overhead high tension line) or (the underground cable) which crosses the site.

N 2. For single connections to a water main (i.e. a single dwelling) the applicant should contact Isle of Man Water Authority Customer Services, telephone 695949.

N 3. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
