### Officer's Report

#### The Site

The site represents the domestic curtilage of an existing property which fronts onto the High Street and backs onto Shore Road which abuts Port St. Mary Harbour. The site has to the north the garden of remembrance and to the south of 32, The High Street.

#### Planning Status

The site lies within an area of Residential use on the 1982p and within an area of Mixed Use Village on the draft Port St. Mary Area Plan.

#### Planning History

Two planning applications have been submitted in respect of this site: PA 95/1837 proposed the erection of a garage and PA 96/1501 proposed alterations to rear door and window: both were permitted.

### The Proposal

Proposed now is effectively the re-building of the rear of the property. At present the building has two sections of rear elevation with a complicated gutter and valley arrangement with each other, the rear of the property and the property alongside. There is a balcony at ground floor level and a long terraced garden beyond leading down to Shore Road.

Proposed is a simplification of the rear elevation, providing one simple rear wall across the rear of the property with a flat roofed dormer in the rear pitch which allows the occupant of that roof to walk out and stand, with balustrading. There is to be a timber screen on the northern end to provide privacy from those in the garden of remembrance and vice versa.

### Assessment

The proposed changes will not result in any adverse impact on the appearance of the property and arguably the appearance of the property will be improved as a result of the proposed works. The proposed window arrangement is perhaps not as sympathetic to a property of this nature as it could be, but the removal of the large windows presently in this elevation at second floor level is to be encouraged.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Fire Prevention Officer recommends consultation in respect of internal access and egress which are matters for Building Control not planning. As such the Fire Prevention Officer should not be afforded party status in this instance.

The MEA should also not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the re-building of the rear elevation as shown in drawings 01 -07 inclusive all received on 18th December, 2006.

PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.

The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.

The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
