### Officer's Report

#### The Site

The site represents the curtilage of Malew House, a substantial dwelling situated on the south western side of Cross Four Ways, to the south of the A7 and to the west of the A3. The house is situated roughly equidistant from both roads and the applicant owns more land to the west.

#### Planning Status

The site lies within an area of an Area of High Landscape or Coastal Value and Scenic Significance on the Isle of Man Planning Scheme (Development Plan) Order 1982.

#### Planning History

The following applications have been submitted in respect of this site:

PA 94/1491 - alterations and conservatory - split PA 95/0919 - erection of conservatory with integral swimming pool - permitted PA 95/1593 - replacement of flat roof with pitched roof - permitted PA 97/1180 - change of use of ground floor from residential to office - refused at review PA 02/1725 - erection of barn and stables - split PA 02/2440 - erection of agricultural barn - permitted PA 04/1162 - first floor extension and conversion of existing garage to tourist/guest accommodation - permitted and PA 06/1588 - erection of garden room and extensions - permitted.

### The Proposal

Proposed is the erection of a triple garage with accommodation above. The proposal is clearly designed to accommodate the space in the roof as the ground floor accommodation includes the triple garage but 3300mm by 6700mm is dedicated to a hall and store behind and staircase. The building has walling built up from the ceiling of the garage, by about 1m to provide more accommodation upstairs. The upper floor accommodation includes a kitchen, lounge, bathroom and two bedrooms. There are two small pitched roofed dormers in the front elevation and a long flat roofed dormer on the rear with external soil vent pipe. The resulting appearance of the rear elevation is poor and does not befit the setting of the property. The ground floor accommodation is deeper than a standard garage - 7m.

### Assessment

The building looks as if it has been designed as a two storey building to accommodate a two bedroomed living unit above. The appearance of the building is not particularly attractive with the annex on the western side and the flat roofed dormer is clumsy and unsympathetic. The proposal is, as is suggested by The Society for the Preservation of the Manx Countryside and Environment, a new dwelling in the countryside with no justification and garaging beneath.

Similar proposals were recently refused at Ballavale in Santon (06/01878) and Foxdale (PA 06/1766).

Also, a number of large trees will need to be removed to make space for the new building. There is an existing garage on site which is to be demolished.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Society for the Preservation of the Manx Countryside and Environment is not directly affected by the proposal and the Fire Prevention Officer raises matters which are dealt with in the Building Regulations: as such neither should be afforded party status in this instance.

R 1. The new building is clearly a two bedroomed dwelling arranged above a large garage in an area where new residential development is generally not permitted. There has been no justification provided for the need for this additional accommodation, in addition to that available in Malew House which is in itself a sizeable dwelling.

R 2. The building is of poor appearance in respect of the external soil stack and clumsy flat roofed dormer on the rear elevation. Furthermore, a number of established and what would appear to be large trees would need to be removed to make space for the proposed building.

- 1. This refusal is without prejudice to a further application for a triple garage of standard internal dimensions and where the accommodation which is available in the roofspace may be used as such ancillary to that available in the main dwelling. The building should not be designed around the first floor accommodation which is effectively a new dwelling in the countryside.
