The building on the site is a three storey Victorian property with projecting bays on the front elevation which overlooks Chapel Bay. #### Planning Status The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Worship which is a rather large designation intended to focus upon the two Churches (St. Mary's and Bay View Methodist) but also incorporates residential and mixed uses in between. On the draft Port St. Mary Area Plan the designation is more specific and identifies the site as Mixed Use Village which embraces the full range of retail, residential, office, tourism and public house uses found in the village centre. #### Planning History The site has been the subject of the following applications: PA 88/0630 - approval in principle for refurbishment of building and conversion to offices - permitted on review
PA 97/0832 - installation of two rooflights - permitted PA 97/1498 - alterations to dwelling and shop - permitted PA 98/0913 - erection of conservatory - permitted PA 02/0699 - change of use from residential to office accommodation - permitted. ### The Proposal The application seeks permission for retention of the existing flagpole which has been erected at the front of the site in the small front garden which is separated from the highway by a low white painted rendered wall and painted railings. The pole is 5m high and displays the corporate flag of the company using the offices accommodated in the building. ### Assessment The pole, whilst high, is no higher than the building and in fact is more or less the same height as the eaves. As such the pole and flag have a more limited impact than would be the case either with a lower or higher pole. The pole is also in the centre of the site so the flag is unlikely to cause a nuisance by noise or the sight of the flapping material, to any nearby residents. The flag to be flown, however, really ought to be associated with the business undertaken in the building and a condition requiring this should be attached. ### Party Status The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status. ### Recommendation Recommended Decision: Permitted Date of Recommendation: 02.01.2007 ### Conditions and Notes for Approval / Reasons and Notes for Refusal C : Conditions for approval N : Notes attached to conditions R : Reasons for refusal - : Notes attached to refusals C 1.
