### Officer's Report

#### The Site

The site defined in blue represents the holding of Ballacricket Farm, located mostly on the eastern side of the B39 Corlea Road to the south of the Cringle Plantation. The farm extends to a sizeable area with the farm buildings in the centre accessed a straight lane from the B39. The farm group includes a range of agricultural outbuildings and a farmhouse.

#### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as "white land", that is, not designated for development.

#### Planning History

The following applications have been submitted in respect of this site: PA 96/1734 - replacement of Dutch barn with new agricultural building - permitted

PA 98/0071 - approval in principle for the erection of a replacement farmhouse - permitted PA 98/1695 - erection of replacement farm dwellings - permitted PA 99/1190 - erection of conservatory and addition of new window, Ballacricket Farm (new dwelling) - permitted PA 01/1002 - erection of agricultural building - permitted PA 01/1181 - amendment to approved dwelling - permitted and PA 05/1737 - erection of horse field shelter - permitted.

### The Proposal

Proposed here is the extension of an existing agricultural building which is situated to the south east of the main group. The extensions will be to the north and south of the building, almost doubling its size but as lean-to extensions the additions have a much lower roofline than the main building.

### Assessment

The proposed extensions will have only a limited visual impact on the appearance of the building. However, Manx Electricity Authority have pointed out that the extensions will bring the building very close to an existing 11kv overhead line and that this may well need to be diverted before works commence. The draft Strategic Plan makes provision for the safeguarding of 9m on each side of a high tension overhead line (Energy Policy 2, Chapter 12).

The applicant has now contacted me and the MEA and has resolved to omit the proposed extension on the eastern side which is the one affected by the electricity line (see letter from the applicant received on 13th February.

There is an objection from the occupants of Ballagilbert Farm who suggest that this extension will be "another blot on the landscape" and may be one in a line of applications for further buildings and extensions. They also suggest that they would like an oral hearing. The extension proposed for approval is relatively small and I cannot agree that this would establish a precedent for further building. The extension is attached to an existing building and its visual impact is negligible. There is no option for an oral hearing in respect of an initial decision.

There are no objections to the application from residents who are closer to the site than Ballagilbert Farm which is around 0.25km away to the north and which shares the same access lane although there are three residential properties between the objectors' property and the application building (Balley Bwaane and 1 and 2, Ballagilbert Cottages). The application building is relatively close to the existing farm group and I cannot accept that the proposed extension will have any adverse visual or other impact.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Manx Electricity Authority refer to matters which are adopted policy in the Isle of Man Planning Scheme (Development Plan) Order 1982 (Part 3, Article 11.2(e) and draft policy in the Strategic Plan (see above) and as such should be afforded party status in this instance.

The occupants of Ballagilbert are relatively close to the building site and may be able to see it from their property and share the same access and as such should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the creation of an extension on the western side only of the existing building, as shown in drawings reference 06/010/01, -02 and -03 all received on 29th November, 2006.

No approval is hereby granted to the extension on the eastern side of the building, which would be unacceptably close to an existing overhead electricity supply.

C 3. The building must only be used for agricultural purposes.

C 4. The external finishes of the extension must match those of the existing building in all respects.
