### Officer's Report

Planning approval was granted in 2002 for the construction of a replacement dwelling at Rosehill Lodge, Richmond Hill, Braddan, this following the purchase of Rosehill Lodge by the Department of Transport to facilitate highways improvements.

The current application seeks approval for the use of the property as tourist accommodation. The property is remote and any additional noise and disturbance generated by tourist occupancy would not, it is considered result in adverse amenity issues.

Subject to an appropriate condition, the proposal is considered to be acceptable.

It is considered that all parties, who submitted comments, with the exception of the following: Chief Fire Officer accord with the requirements of Planning Circular 1/06 and are therefore afforded interested party status.

C 1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

C 2. This approval relates to teh plans and inforamtion submitted as part of this application and date stamped 5th October 2006.

C 3. The occupation of the accommodation dwelling hereby approved shall be limited to tourists by way of short term holiday lettings subject to the following:

a) No individual holiday letting shall exceed a length of 28 consecutive days between the period commencing on the 1st April and ending on the 31st September in each calendar year. (“the holiday let period”).

b) Between the period commencing on the 1st October in each calendar year and the 31st March next following (“the non-holiday let period”) individual lettings (which may include short term lettings to other than tourists) may exceed 28 consecutive days in length provided that all such lettings must terminate on or before the 31st of March in each calendar year.

I confirm that this decision accords with Government Circular Nos 44/05 (Delegation of Functions to Director of Planning and Building Control) and 47/05 (Delegation of Functions to Senior Planning Officer)
