## Officer's Report

### The Site

The site represents the residential curtilage of an existing dwelling which sits on the northern side of the Fistard Road just to the west of the entrance to St. Mary's Glebe.

### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 and the draft Port St. Mary Area Plan as Residential.

### Planning History

PA 01/2075 sought permission for alterations and refurbishment of dwelling - permitted.

### The Proposal

Proposed here is the creation of a parking bay on the eastern side of the house. The bay would facilitate parking at right angles to the road and would be 8.7m in depth which is not quite two standard car lengths.

The bay would have surrounding walling up to 1.2m in height over the footway and retaining walls further back into the bay to support the surrounding garden. The existing front boundary wall is a 1.6m (approximately) high stone wall with integral post box.

### Assessment

In order to achieve visibility for those in vehicles emerging from the site, the whole of the front wall will need to be lowered to 1m. This is not shown on the drawings. Whilst some visibility is available over the footway, this does not protect pedestrians using the footway to approach the bay and be seen by the driver. The footway is not 2m wide so the vehicle will be in the roadway before the driver is able to see clearly along the road.

The Commissioners do not object to the application but suggest that a traffic mirror be placed on the wall, perhaps in view of the above comments.

The Department of Transport objects to the application on the basis that there is no visibility for pedestrians or vehicles approaching the site.

The proposal would not make provision for visibility of cars and pedestrians approaching the site and as such the parking space may create an unsafe environment in road safety terms. The application should be refused without prejudice to a scheme which makes adequate provision for visibility.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The proposed development does not make adequate provision for visibility for drivers emerging from the site and as such road safety - including the safety of those using the footway - would be compromised by the proposal.

NOTE: this proposal is without prejudice to a scheme for the provision of off-road parking but where those in vehicles emerging from the site can adequately see those walking or driving towards the site. The applicant is advised to consult the Department of Transport in this respect.
