### Officer's Report

#### The Site

The site represents the curtilage of Rushen Primary School, situated on the north eastern corner of Four Roads, the junction of Church Road and Castletown Road (A7).

#### Planning Status And Relevant Policies

The site is designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Education, reflecting the use of the site as a primary school.

#### Planning History

The following planning applications have been submitted in respect of this site:

PA 90/0354 - siting of mobile classroom - permitted

PA 90/1940 - siting of 2 mobile classrooms - permitted

PA 91/4202 - siting and relocation of mobile classrooms - permitted PA 91/4205 - provision of Phase 2 refurbishment, playground extension and bus lay-by - permitted PA 92/0960 - internal alterations - permitted PA 93/0210 - formation of car park and construction of new porch - permitted PA 93/1602 - alterations to create new porch, bus lay-by and car park - permitted PA 97/1620 - installation of replacement windows and doors - permitted PA 04/115 - installation of additional window - permitted PA 05/0658 - installation of new double doors into existing window and creation of new entrance ramp and hoarding - permitted and PA 05/92381 - construction of ramps and steps - permitted.

### The Proposal

Proposed now is the creation of a safe play area on the north western side of the site next to Church Road and the extension to the existing car park with the loss of existing grassed area. Fencing will be erected to the south of the new play area and the existing bin store will be relocated further inside the site.

### Assessment

The impact of the works is confined to the roadside and no residential properties will be affected. Additional parking spaces will be provided although the distance between some of them is a little tight as is noted by the Department of Transport. The safe play area is welcome. No trees or valuable vegetation or greenery will be lost as a result of the proposals

The Commissioners' suggestion that a drop off and pick up point be considered in the adjoining field should be added as a note. This would involve some change of use and engineering operations and should not be pre-judged before any scheme is put together.

Whilst the provision of disabled persons' spaces is desirable, the recommended 3 spaces represents half the additional provision being proposed and may be considered excessive. The provision of wider, disabled persons' spaces would also reduce the number of spaces available. As such I would recommend a note rather than a condition requiring the provision of disabled persons' parking spaces.

### Party Status

Rushen Parish Commissioners and Department of Transport The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst Manx Electricity Authority represents a statutory authority, the points raised in correspondence relate to working practices and not planning and as such should not be afforded party status in this instance.

Disability Access Officer raise suggestions about disabled persons' parking facilities which is a material consideration and as such should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the creation of additional car parking and the provision of a safe play area all as shown in drawings reference 16656/01, -02 and -03 all received on the 14th September, 2006.

N 1. The applicant is recommended to make provision for parking spaces which are fully usable by disabled persons.

N 2. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.

The applicant is also advised to contact the M.E.A. for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
