Please reply to the Chief Executive Our ref: RAH/AJC 5th January 2006 Dear Sir/Madam,

ON APPEAL: PA05/00360 – Mr A Scarlett – Partial demolition of farmhouse and conversion from domestic dwelling to holiday accommodation at Ballakerkey Farm, Shore Road, Glen Maye, Patrick.

I refer to the recent appeal hearing in respect of the above planning application.

In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.

I am directed to advise you that the Minister, having considered the report, has agreed to accept the recommendation of the appointed person. Accordingly, he has directed that the appeal be allowed, that the decision of the Planning Committee to refuse the application be reversed, and that approval be granted subject to the conditions as set out in the Schedule to the report.

In pursuance of his powers under the above Acts and Order the **MINISTER** for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by Mr A Scarlett for the partial demolition of farmhouse and conversion from domestic dwelling to holiday accommodation at Ballakerkey Farm, Shore Road, Glen Maye, Patrick subject to the conditions specified on the attached schedule and numbered 1-4.

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. Prior to the commencement of works on site, the line of the existing public outfall pipe must be identified and protected whilst all works are carried out. No new buildings, trees or shrubs may be planted within three metres of the pipe at any time.

3. The new accommodation must be available for bona fide tourists with no individual tenancy exceeding four consecutive weeks in duration, between the months of April and October, and it shall be used for no other purpose including permanent residential accommodation.

4. Prior to any demolition or building works in connection with the development hereby approved, the old sow house at the western end of outbuilding to the west of ‘Shady Moar’ shall be demolished and all materials from it shall be removed from the site.
