### Officer's Report

#### The Site

The site represents the domestic curtilage of an existing dwelling situated on the western side of the High Street, between Athol Place and the junction with Park Road. The site accommodates an existing terraced dwelling.

#### Planning Status

The site lies within an area designated on the 1982p as Predominantly Shopping and on the draft Port St. Mary Area Plan as Mixed Use.

#### Planning History

Two applications have been submitted previously in respect of this site:

PA 996/1213 proposed internal and external alterations and was permitted and<br/> PA 05/2004 proposed the change of use of the ground floor retail/commercial to residential use and was also permitted.

## The Proposal

Proposed now is the replacement of an existing shop front and large window with a smaller scale sliding sash window together with the replacement of the upper floor windows with the same timber framed sliding sashes. The existing dormer window is to be repaired. The works will involve building up the walling around the new, smaller window.

## Assessment

Whilst the proposals will change the appearance of the property and it will become residential rather than commercial, this change in use has already been sanctioned under the earlier application and the finished appearance of the property is not objectionable nor will it be out of keeping in the streetsce.

## Party Status

Port St. Mary Commissioners and Department of Transport The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Disability Access Officer represents a statutory authority, the points raised in correspondence relate to Building Control matters and not planning and as such should not be afforded party status in this instance.

C 2. This permission relates to the replacement of windows as shown and described in drawings reference 0512A/01 received on 23rd August, 2006 and 0512A/02A received on 11th September, 2006.

N 1. The Applicant's attention is drawn to the recommendations of the Disability Access Officer, a copy of which is attached to this notice.
