The building sits on a footprint with a small external seating space facing into Atholl Place. #### Planning History The site has been the subject of the following applications: - Change of use from retail shop to fried fish shop, 41 Michael Street, Peel. (89/01733) – Application Permitted - Change of use from retail tobacconists to licensed betting office, 41 Michael Street, Peel. (90/00109) - Application Permitted on Review - Installation of 130 cm satellite TV dish, 41 Michael Street, Peel. (90/01010) - Application Permitted - Alterations and extension to bookmakers and conversion of first floor from residential to office accommodation, Atholl Place, 41 Michael Street, Peel. (99/00640) - Application Permitted - Erection of satellite dish (00/01891) - Application Permitted - Alterations and conversion of former betting shop and office to a cafe/tea rooms on ground floor and two apartments on upper floors, and alterations to highway (04/02444) - Application Permitted - Change of use to enable tables and chairs to be placed on extended paved area for use of cafeteria customers during business hours (05/01855) - Application Permitted - Formation of opening lights to create serving hatch to outside seating area and installation of a foldaway awning to front elevation (06/00417/B) – Application Permitted ## THE PROPOSAL The proposed is the retention of advertising signage to the Shamyr Hey Tea Rooms, 41 Michael Street, Peel. REPRESENTATIONS Peel Town Commissioners RECOMMEND REFUSAL. They state: "These premises are in the heart of the conservation Area and it is felt by the Commissioners that there is a surfeit of advertising signage both on the tea room windows and on the stand alone signs on the outside seating area." The Highways Division of the Department of Transport Do Not Oppose the application. A resident of The Eaves, 26, Derby Road states: "The proposed signs are not in keeping with any of Peels conservation area in any form,..." ## ASSESSMENT The Conservation Officer has provided the following assessment of the application: "I have considered the content of the application with particular consideration to Policy CA/2 SPECIAL PLANNING CONSIDERATIONS for Conservation Areas as set out within Planning Policy Statement 1/01. The property has an over abundance of signage which causes visual clutter to the frontage of this building in a highly prominent position in the Peel Conservation Area. Whilst I accept that not a great deal can be done to remove the free standing signage, that that is fixed to the building has to be considered too much. I consider that this has an adverse affect on the character of the Conservation Area." I would concur with the views expressed by the Conservation Officer, and would recommend that should the application be refused, the applicant be advised to remove the signs within 28 days of the date of the decision. ### Recommendation Recommend Refusal of this application. ### Party Status The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status. It is considered that the occupier of The Eaves, 26 Derby Road, Peel who submitted comments, does not accord with the requirements of Planning Circular 1/06, given their distance from the application site, and are therefore not afforded interested party status.
