### Officer's Report

#### The Site

The site represents the footprint of the building presently used by Port Erin Commissioners as their offices/surgery, located on the northern side of Station Road between the Isle of Man Bank and the newsagent’s and opposite the railway station.

#### Planning Status

The site lies within an area designated on the Port Erin Local Plan as Mixed use and where commercial uses - banks, shops, offices, public houses, eating establishments, launderettes and a petrol filling station all co-exist.

### Planning History

Planning permission was sought and granted for the erection of a flag pole (PA 97/0305) and for the creation of an interview room (94/0539) at these premises.

### The Proposal

Proposed here is the change of use of the ground floor of the building from part of the offices operating in the remainder of the building, to a retail facility. The ground floor is already separated from the upper floors by the entrance hall to the stairs so the separate use and indeed a different use of the ground floor will not prejudice the use of the remainder of the building.

The use of part of the building for retailing is entirely in keeping with the designation of the site for Mixed Use.

The recommendations of the Disability Access Officer are commendable. However, the application is for a change of use which does not involve building works, so the provision of new doors (particularly automatic doors which may be practicable given the limited space available in the front entrance way). Many of the suggestions involve internal works in any case which would not be controlled by the planning system.

### Party Status

Disability Access Officer, the Isle of Man Water Authority and Fire Prevention Officer are or represent statutory authorities and as such should be afforded party status in this case.

## **C 1.**

The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

## **C 2.**

This approval relates to the use of the ground floor space shown in drawings K088/P/10-02 and -/02 both received on 16th June, 2006 as a shop as described in Class 1 of Schedule 4 of the Town and Country Planning (Permitted Development) Order 2005.

## **N 1.**

For a change in the water supply to a premises (domestic or commercial) the applicant should contact the Isle of Man Water Authority Byelaws Inspector (Michael Karren), telephone 695957.

The Applicant's attention is drawn to the recommendations of the Disability Access Officer, a copy of which is attached to this notice.
