### The Town And Country Planning (Development Procedure) Order 2005

In pursuance of his powers under the above Acts and Order the **MINISTER** for Local Government and the Environment, following report by the appointed person, does hereby **REFUSE** the application by Mrs D A Forster – Demolition of existing dwellings, garage and outbuildings and the erection of four replacement dwellings with integral garages and additional on site parking, at Cliffside and End Café, the Promenade, Laxey for the following reason:-

1. Having regard to
(a) the steep slope at the back of the site and the associated history of land-slip; and to
(b) the location of the site relative to the sea-wall;
there is the possibility that the occupants of the proposed dwellings would be in danger due to either further land-slip or inundation. There is not within the submitted application evidence that these matters have been satisfactorily addressed by suitably qualified and experienced advisers.
