### Officer's Report

#### The Site

The site represents a farm holding which comprises two parcels of land on either side of the Mullinaragher Road which links the St. Mark’s Road with the Clannagh Road.

#### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as white land, that is, not designated for development.

#### Planning History,

The following planning applications have been submitted in respect of this site:

- PA 06/0806 - erection of implement and machinery store - pending consideration
- PA 04/2288 - alterations and extensions to dwelling - permitted
- PA 92/0538 - construction of dining room extension - permitted

PA 90/1472 - erection of glass house and installation of double doors to barn in stone gable wall - permitted

PA 85/0542 - partial demolition of barn complex and construction of new farmhouse – permitted.

### The Proposal

The application proposes the levelling of a part of the field between the existing farm buildings and the Mullinaragher Road. This is for the construction of a marquee for a birthday celebration in September this year. This area for the levelling is the same area as where the agricultural building proposed in PA 06/0806 will be erected. If the application for the building is refused and the levelling permitted, the area will be reinstated following the dismantling of the marquee.

### Assessment

The site is very well screened from the road immediately in front of the site, by trees and bushes. The site is visible further to the north from the Mullinaragher Road where the site presently appears as a sloping field. The introduction of a levelled area will not, in my view adversely affect this view of the wider countryside although whilst the levelling is being undertaken, there may be some visual intrusion temporarily. the use of this area temporarily for a marquee is also acceptable, and I suspect something for which planning permission is not strictly necessary.

The applicant has indicated that if the barn is not approved (it is recommended for approval) then the excavated area will be restored if necessary. I see no reason to require this even if the agricultural building is not erected. The visual impact of the levelled area is limited and may be useful for agricultural storage. As the agricultural building has been proposed, it is most likely that it will be erected.

### Party Status

The Manx Electricity Authority and Malew Parish Commissioners are or represent statutory authorities and as such should be afforded party status in this case.

C 2. This permission relates to the undertaking of levelling works as shown in drawings 4052-LP, 4054-SP/A, 4052/P1 and 00805/1 all received on 12th May, 2006.

Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
