## Department Of Infrastructure ### Memorandum **TO:** Miss Jennifer Chance, Senior Planning Officer **FROM:** Mr Steven Stanley, Planning Officer **REF:** PA06/00874/B Demolition of existing and erection of a replacement garage, 38 Derby Road, Peel **DATE:** 3rd August 2010 ### Request For Extension Of Time The above application was approved 1st September 2006. The application was a detailed application and as such the approval was valid for a period of four years. The approval will expire 1st September 2010. The Department has received a request for an extension of time to the approval. The applicant sets out that he has recently purchased the property. No proposed period for the extension of time has been given. The Town and Country Planning (Development Procedure) Order 2005 makes provision for “any person interested in the land to which a planning approval relates may, before the expiration of the period referred to in paragraph (1), apply in writing to the Department for the extension of that period, and the Department may, subject to paragraph (2), extend that period by such further period as may be specified in the application or such lesser period as the Department may determine” (paragraph 13(3)). Planning permissions are generally granted for a period not exceeding 4 years. The Isle of Man Strategic Plan was adopted June 2007. As such the policy framework which existed at the time that this application was considered and determined has changed. However it is judged that the factors taken into account when considering the application have not changed. The development is of a relatively minor nature and was not controversial at the time of determination with no objections being received. In these circumstances it is judged that to extend the approval by a further year would be acceptable. If this is accepted, the extended approval would remain valid until 1st September 2011.
