In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 20 July 2006, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. This approval is in principle only and will remain valid for a period of two years within which time no development may take place until such time as details of the reserved matters (siting, design, external appearance, internal layout, means of access, landscaping) have been approved by the Planning Authority. Such reserved matters should form the subject of a single application.

2. The proposed development must be connected to the main foul sewer.
**NOTE:** A Drainage Connection Fee will be payable to the Drainage Authority on this development

3. There must be no discharge of surface water to the main foul sewer.

4. Any subsequent application for detailed approval must indicate a layout which avoids the archaeological remains and include details of the archaeological watching brief to be undertaken.

5. Any subsequent detailed application must contain details of the existing trees and hedges to be retained on site.

6. Construction traffic must use only the temporary access indicated on drawing no. 4043/2; this temporary access must be removed and the land over which it passes must be restored to its current condition within one month of the completion of building operations; details of this access and the arrangement must be included in the application for Reserved Matters.

7. The application for Reserved Matters must include details of the proposed improvements to the visibility at the junction of the Balladoyne Estate Road and Peel Road, and of the proposed estate road widening; these works must be completed prior to the occupation of any of the dwellings.

NOTE For the avoidance of doubt, any application for approval of Reserved Matters must indicate single storey dwellings with no dormer accommodation, in accordance with Policy RES/P/1 part (b) Development Brief.

NOTE For water connections that comprise more than a single connection to a water main or service, or where new water mains and hydrants will be required, the applicant should contact the Isle of Man Water Authority Planning and Projects Section, telephone 695958.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

You should note that a copy of the Officer’s report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.

No development July be undertaken until such time as the relevant reserved matters have been approved by the Planning Authority.
